shoplifting with prior felony

with a prior felony (21 years back) and facing a shoplifting charge (under 1 dollor amount), will prior felony influence the sentencing? shoplifting under 1 dollor has a fine of 250 dollors . thanks.

The prior record always influences the outcome of the current charge. However, the maximum penalty for a first offense shoplifting, as you say, is a $250 fine. Therefore, your record can't hurt you very much. Given the span of time betwen the felony and the shoplifting, the nature of the present offense and the value stated of the theft, I wouldn't expect more than a CWOF and fine. Try to avoid the conviction, even for the minor offense.
