simple assault on daughter by father

My son slapped his 14 y/o daughter on the face after she kicked him. He has been to pretrial where mom and daughter showed up and prosecutor wants to move forward because daughter and mom say dad punched her. There is a divorce going on and mom is big time parental alienation. Mom was not present when the incident occurred. What can happen for puishment? P.S. my son is a criminal lawyer also. They go back to court for another pretrial on 3 /24. Thank You

It's hard to answer the question in a box, but it depends on whether or not your granddaughter has a fifth amendment privilege not to testify. If your son is a criminal lawyer, he has probably already thought of this. Mom can't testify if she wasn't present.
