my son is being charged for domestic against my daughter but she wants to do the fifth amendment because she never realize that it would go this far. Would that be the right choice?

Her fifth amendment right would only apply if she were to testify and she would incriminate herself, i.e., she also struck him or that she lied about the whole incident. There are ways that the case can be dismissed, however there are some issues. Was there someone else that witnessed the alleged assault and battery? If there was, then the Commonwealth may not even need her testimony to go forward with the case.
