Legal Question in Criminal Law in Massachusetts

Spouse forged signature on Check

My spouse closed my IRA account without my permission or knowledge. Spouse retreived the check from our mailbox, forged my name and deposited the check into an account which had only his name. We have since separated and I found out only after separation that this occured. I have a copy of forged check which I requested from the company where the IRA account was held. Is there any way I can be compensated for this illegal activity, considering I was not the one to close the account or sign the check?

Re: Spouse forged signature on Check

If there is a divorce or separate support action filed by you, ask the attorney who is representing you in that action to bring it to the Court's attention. Alternatively, if you choose to do so, you could report it to the local police or District Attorney's Office for potential prosecution. But that may result in consequences against your spouse, like a criminal conviction, that will lessen your chances of getting a support order.
