Legal Question in Criminal Law in Massachusetts

My spouse made false allegations against me and got me arrested. She had a no abuse restraining order against me and wanted to live with me so that relationship with child would go on.

She claims that 2 days back I pushed her and violated the no abuse order. She never called police at that time. Is this a violation? Will it effect my H1 B visa extension?

Hi.

Yes, if she reports the incident to the police, you'll be arrested for a 209A violation. It is imperative that you do not plead guilty, or admit to the offense. Your visa will not be extended if you've been found To have committed a crime of domestic violence, no matter how minor. You'll be ineligible to apply for other immigration benefits as well.
