Can the state charge you with assault with dangerous weapon with no weapon?

No, but the definition of what a "weapon" can be is very broad.

Weapon, for the purpose of this statute can include a shod foot or any item that can be "used" as a weapon. If you have been charged with this crime it is a felony in MA and you should hire the best legal counsel that you can afford as soon as possible.
