RE: State Parole/Federal Detainer
Let's say a defendant is currently serving a 3-5 year sentence with the State, but they have a federal detainer larged against them. When their 3 yr time is up they go up against the parole board. Can they still make parole even though they have a federal detainer larged against them, or does the federal detainer hinder them from making parole?

Federal detainer "detains" them until the Federal matter is resolved. Even if the parole board decides to parole the convict, he of she has to be held in custody until the Federal Court acts on the detainer. In short... inmate needs to get a writ of habeus corpus and get action taken on their federal matter.
