Legal Question in Criminal Law in Massachusetts
State to state transfers
My husband and I live in Massachusetts and would like to move to Virginia closer to our families. In January 2001 my husband was accused of Sexual Assault to a minor. We could not afford a good defense attorney because we are a low income family. So instead of spending the rest of his life away from us , he pleaded to a 2.5 year sentence in a County jail, 5 years probation and a lifetime of parole. He has been forefilling his obligation to his sentence for one year without any negative occurances. My question is Could the state deny his transfer because he has lifetime parole(Massachusetts Probation states that they will not transfer because of his lifetime parole obligations to the state.)?if so, Can we have the parole part of his sentence amended? or omitted in order to relocate? Desparate for some advice!!!!

Re: State to state transfers
There may be some procedure for terminating lifetime community parole although it is unlikely to occur in your case any time soon.
Blaming the defense lawyer for your husband's circumstance doesn't get you any points with me.
You may want to take another tact.
Good luck
