Legal Question in Criminal Law in Massachusetts
strange subponea questing
I recently was subponead, by the plantiffs lawyer over harrassing e-mails that were being sent about her and a male friend, the male friend is also my friend, I do not know the plantiff. Her lawyer asked me if I was intamately involved with this male friend, I told them yes and he began to ask more detailed info, I thought I was their to hand over copies of the e-mails. It turns out this lawyer then told his client of my relationship with the mutal male friend, now my male friend is upset and told me I should never have told the lawyer that and I should have said we were ''just friends'' this male friend was/is involved with the plantiff.
My question is did the lawyer have the right to ask me that question and then tell his client???

Re: strange subponea questing
Yes and yes. If your male friend asked you to lie, or omit the truth, then he could be guilty of suborning perjury. When you are subpoenaed, you are placed under oath to testify truthfully; if your friend asked you to commit a crime (perjury) then he is clearly more concerned with himself than with you.
