Legal Question in Criminal Law in Massachusetts

i am the suspect of an assault case it was basically a bar fight in which there are witnesses on both sides. my question is. the main witness on my behalf. well her ex husband has obtained a copy of the police report and is mailing it to the family members of my witness and trying to have them talk my witness into not helping me in court. he is also saying that he is going to show up at the court house to "cause trouble" is this harassment or intimadation or witness tampering? what should i do? thank you for your time. Sean.

You should notify the District Attorney's office. Intimidation of a Witness and Witness Tampering are criminal offenses that come to mind from your explanation of events. You should obviously have representation here as well. Make sure that you hire the best attorney that you can afford. You only have one opportunity to get this right and the consequences will remain on your CORI (Criminal Offender Record Information) for the rest of your life and effect you negatively if not handled appropriotly now. If you need a lawyer call me at (877) 752-7501.

I would contact the police. Mass General Laws chapter 268 section 13B makes it a crime to "mislead...intimidate...or harass...another person who is...a witness or potential witness at any stage of a criminal investigation...;...a person who is or was aware of information..." Witness intimidation is a felony and punishable by 10 years in prison. Feel free to contact me if you have further questions. (781) 335-0374

Because YOU are the suspect, you have to be very careful about whom you speak to and what you say. Anything you say can be used against you if you talk to anyone other than YOUR attorney with whom you have a confidential relationship. It is true that witness intimidation is a crime, but you have to be careful not to get yourself into more trouble while trying to fix this.
