Legal Question in Criminal Law in Massachusetts

Threatening to Commit a crime?

My brother was arrested for 2 counts of threatening to commit a crime, distrubing the peace and violation of a restraining order by my mother. She wants the charges dropped. His public defender wants a trial because of previous child abuse, but records are sealed. He is young and just started working. I am in PA and cannot call to find out where to get help. Both want this to end (my mother and brother). Please help.

Re: Threatening to Commit a crime?

Your problem is that you are out of the loop.

Once charges are filed & a complaint is issued, the control of the case, largely, is taken away from the complainant and is vested with the prosecution. If there is a difference of opinion regarding the strategy that strikes at the core of the attorney-client relationship, it is the client that must clarify the situation with their attorney, and if not possible, get another consultation, and/or get another attorney!
