Legal Question in Criminal Law in Massachusetts

first time offense for lewd behavior

I know a family member who is a good

person who was arrested for lewd

behavior for using a camera phone

in a men's public restroom. The

phone service had been turned off so

no pictures were actually taken.

This person goes to court next week.

He has never been in any trouble

before and holds down a steady job.

Would anyone care to tell me what

they think will happen in court? Thank you in advance.

Your question should also address what this person ought to be doing. Sexual offenses are treated with great energy. There are a number of present dangers and future problems which must be taken into account. Your friend would be foolish not to consult an attorney, and discuss this matter before he puts his first toe in the Court room. Unless there is a question of bail or a dangerousness hearing, the facts will not be read; merely a plea will be tendered. An attorney experiences with criminal law and sexual charges should be consulted at once.

It depends on what your family member was doing with the camera.

It depends on what can be proved.

Next week, the ADA will read some grizzly facts to the court. Your family member will be asked to enter his plea: Innocent or guilty.
