Legal Question in Criminal Law in Massachusetts
Type Your Question Here...I'm confused I received a summons with two counts 1. leaving the scene of property damage 2. False report, but two weeks before that I get a citation in the mail with one count of offense. Which is leaving the scene of property damage. Another question is why didn't the police officer hand me the police report when I went to report my car being stolen instead of mailing? I looked at the citation and the date of issue was the same date I went to make a report. Plus the officer told me that the car is on hold until the fraud investigator see the vehicle. I don't know why he bothered getting a fraud investigator when he's already accusing me of false report according to the summons. The officer doesn't believe my car wasn't stolen due to the fact that there were no damages to the doors, windows, and ignition. Which I told him someone took my keys while I was sleeping at my friends house. That day he was throwing a new years eve party. I also would like to mention that a few weeks later I had my other car stolen and guess what there were no damages to the doors or windows only the ignition.

Hi. These cases cannot be proven without someone identifying you as the driver. There are also often problems with the citation that can lead to dismissal of your case.
I advise you to consult a lawyer before continuing to speak to the police.
