Unsupervised Probation

If a young man now starting out in life gets arrested for a Class D drug and is put on unsupervised probation, does this stay on his record after probation. Can he seal this record, he has made great changes, but this affects his job hunting and finding a home.

There are provisions to seal a record that has nothing but a marijuana charge. There are also ways that a person can seal his/her record for all sorts of crimes after an extended period of time crime free. The marijuana charge can be sealed without such a long wait. You should contact an attorney for assistance. The legal system is really not very user friendly for the average lay person.

While there are provisions in place to allow for sealing this record, you should bear in mind that the fact that the record was sealed will still appear on his record. In a case such as this, the "cure" may be worse than the disease. What I mean is this: someone inquiring into this young man's record will have no way of knowing if the sealed charge is a simple Class D possession (which it is), or whether the sealed charge would reveal that he is a sex offender or a murderer. All they will see is a sealed record. Given the relatively minor charge on his record (possession of marijuana), I wonder if sealing it will create more problems than leaving it unsealed.

Yes it remains on his record which can be sealed. he should retain an attorney to assist with this. Good luck!
