Legal Question in Criminal Law in Massachusetts
Can video, obtained through invasion if privacy, be used to convict the victim of a crime? In a case in Maine an alleged prostitute taped her " clients" secretly. Are they admissible in court against the " johns"?

Certainly defense counsel will file a motion to suppress the tape, if one exists for each potential defendant. My understanding is that the District Attorney (according to news reports) is only going forward with cases that they can prove without the need for non-law enforcement witnesses. Such suggests that they may attempt to use the ledgers, and not the video, to convict. A video likely will not show that money was exchanged which suggests that there are writings to support their cases. I am also licensed in Maine.
