violation of probation

I was arrested in May for tagging/graffiti and was then put on probation for six months. Last night I was arrested for public drinking however they did not test for intoxication and I don't know whether to plead guilty or not. Any help would be appreciated

If you are still on probation and you plead guilty you can suffer stiffer consequences on a probation surrender on the tagging charge. I would definitely hire a lawyer to protect yourself. Martha Kovner

First, you do not have to be intoxicated to be considered to be drinking in public. However, this is a very minor offense, a city ordinance, and courts do not like to take up much time dealing with this type of case. Get a lawyer, request your trial rights, and you will likely obtain a dismissal on court costs at some point.

Any plea would be an automatic violation of your probation. So I would definitely not plead out. If you have any questions, feel free to contact me.

From the sound of it, you should not plead guilty. However, you are facing new charges in addition to the possibility of a probation violation on your old charges. You need to consult with a lawyer to help you in this matter.
