Legal Question in Discrimination Law in Massachusetts

employee at will in pervasive hostile work environment

Employed since 2001 as sales rep (emp.at will) full-time, I'm 54, female, good work performance stats. was recruited back to this employer with assurances of higher close % leads (up-grades) by my supervisor. Instead, in retaliation to my continued friendship with co-worker who has bi-polar disorder, and for retailiatory tx in other areas my work-load has been so significantly reduced and given to younger and newly hired male & female employees, promotions have been bi-passed to same, and the environment has become so emotionally devastating to me that I have stopped going to work. No viable options to address any issues at this company, which is huge with multi-state locals. It is operated as though EOE does not apply, I was told ''if you don't like it, leave'' by project director. MCAD is so ''understaffed and underpaid'' the one man in charge of my territory is yet to return call. I am seeking other employment, and wonder as to limited resources to pay legal fees. What do I do here? My case is verifiable, the companies policies are obviously vulnerable to the two-prong negligence in discrimination laws, I've found precedents for my circumstances. Help?

You have 300 days in MA to file with the MCAD. If they don't call you, go to their office and demand an itake interview. Be sure to emphasize the facts about assignment of job to younger persons and failure to promote. Also be prepared to further describe what you mean about your friendship with your co-employee and how that resulted in retaliation. If you do quit, still file for unemployment. You can truy to prove you were the victim of discrimination or harassment and had to leave.
