auto accident under the influence?

Hello,

I was involved in an auto accident while I was under the influence of alcohol. I recently recieved information that the insurance company did a test of my blood alcohol to determine my PIP benefits which I am not getting because I was found to be under the influence. there was noone else involved in the accident and I was knocked out upon impact, so I did not speak to any police officers. My question is, can the police come after me for a drunk driving charge althought it has been 3 months since the accident. Is there some sort of after the fact law. I really don't want to go through another headache. Thank you

I am sorry to tell you that the police may press charges for the OUI for at least 6 years after the accident, as long as you got a citation for OUI at or near the time of the events.
