Legal Question in DUI Law in Massachusetts

My brother lives in Mass. He is on a year "probation" for an OUI ( unsupervised I believe) He is now disabled and unable to work, unemployed etc. and soon will loose everything he owns. My sister & I live in NY and want to bring him here to take care of him. Can he come? And how do we proceed?

Your brother needs to sit down with his probation officer and make the request. It is not unusual to transfer probation to another state. If your brother is unable to work, you may consider asking his attorney to file a motion to revise and revoke the portion of the sentence that requires him to pay money. If he can't afford it at this time, the court may change the sentence.
