Legal Question in DUI Law in Massachusetts

Drunk driving accident

Lets say Gail drove her car after

having dinner and several drinks. She

fell asleep at the wheel and ran over

and killed a pedestrian. Prosecuted

for manslaughter, she raised the

defence that she did not intend to

hurt anyone and because of the

drinks did not know what she was

doing. Was this a valid defence?

No. If you want further information, write in the first person. I do not think this site is here for the purpose of answering theoretical questions. Lets say Gail has a school paper, SHE should do the research and not ask lawyers what the answers are. Lets say Gail really did have the drinks and drive and kill someone. She should then hire a very good attorney and not look at theoretical issues.
