Re: drunk driving
Retain an attorney to represent you immediately and speak only with your attorney about this as your CDL and your livelihood are at stake and you may have a triable case. Good Luck!
Re: drunk driving
yoU WOULD BE STUPID TO GO IN WITHOUT A LAWYER ESPECIALLY SINCE YOU'VE ALREADY LOST YOUR LICENSE FOR THE REFUSAL AND ON TOP OF THAT YOU HAVE CDL LICENSE AT STAKE!
Re: drunk driving
It would be absolutely foolish NOT to consult with an attorney before your next hearing. Without the breath test (BT) as evidence you may have a very triable case since you were wise enough not to proovide that damaging piece of evidence (BT result). There are specific issues with a CDL license and if you don't beat the charge, you may very well lose your CDL and your livelihood. The money that you are trying to save now will be long forgotten in 5 or 10 years as your OUI result stays with you for life. You can read a lot about MA OUIs on my website at www.LawWorcester.com
I know that this economy is making things very difficult for many people, however, this is not an area to cut corners.
Re: drunk driving
Of course, I'm biased as I am a lawyer and always think you will do better with one. In Massachusetts with an OUI you should hire a lawyer. There is no question.
The laws are very strict about drunk drivers and I would love to know more information about you getting pulled over and whether or not you have a previous OUI.
