Legal Question in DUI Law in Massachusetts

DUI Insurance coverage

My niece was driving my father car (whom she lived with) while being under the influence of alcohol. She some how crossed the highway median and collided with another vehicle. She did not survive the crash the 2 passengers in the other car did but are in critical condition. We want to know if my father's insurance will cover the funeral costs and how to protect his personal saving in the event of a lawsuit since he was not in the car or awhere she had the car.

Re: DUI Insurance coverage

Please accept my condolences on the loss of your sister. It's difficult to speculate what legal action may arise under these circumstances, but the first thing your father needs to do about this is to find out from his insurance company what his policy covers.

Re: DUI Insurance coverage

My apologies -- I said "your sister" in my earlier response when I should have said "your niece."

Re: DUI Insurance coverage

Please accept my condolences on the death of your niece. Your father should retain an attorney so he can review his insurance policy coverage with an attorney before talking to anyone including his own insurer. Good Luck!
