Can the owner of a car who is a passenger, be held responsible if the operator is not licensed.

Actually, with the passage of Melanie's law, some police departments are charging car owners with allowing an unlicensed operator to use their vehicle. It is a criminal offense. If you get a subpoena you should hire an attorney for every step at the process. I have had success getting this charge dismissed at Clerk's Hearings.

Yes, it is unlawful to allow an unlicensed person or an intoxicated person operate your vehicle. Retain an attorney and discuss this ONLY with that attorney.
