Is it legal for a collection company or any other to pursue

action to collect a sum of money due for a course that was

never taken by the student. She never attended the course ever, and i tried as her mother contacted the college and told them that she would not be taking that course. The collection agency has just informed me that they will take action and send the college she is now attending some kind of statement saying she never paid for this course and i was told by this agency that the college she is attending will not let her continue with her next semester (jan 2006)

until this bill is paid. I asked the agency for any and all

copies of forms my daughter filled out and they said they didn't have to send anything to her. That a promissary note

was all they needed. I said she never signed a promissary note to them and they said they didn't need a signature that she ''bought a seat'' in that class and would have to pay for it whether she attended or not. This was a class she signed up for in the spring or summer of 2004 for september 2004 and never attended. NOT ONCE. She has just started her first semester as a freshman august 2005. I asked for any way that she could withdraw from this class and they said no.

Did she ever sign up for the class? It is unclear whether your stating that she signed up and cancelled or not? If not, they better have proof and then, your best recourse is straight to the consumer regulator or attorney general in your state....
