Legal Question in Education Law in Massachusetts
Notification of leaving employment
My schools collective barg. agreement indicates that a teacher must give a 30 day notification if leaving the employment of the town. If the job offer is accepted later than 30 days out, is the town capable of requiring the 30 days and making you work the additional days? Is there recourse for the town if notification is only two work weeks?
What are the employee's options.
Thank you!

Re: Notification of leaving employment
Without seeing the CBA it is tough to answer this one, but I would look to two things - look to the CBA and see if it contemplates any impact on your benefits; also talk to your union rep and find out about past precedent in your district beyond the language of the CBA. Bottom line - you can leave your employ whenever you want, the only impact for most people lies with insurance and retirement benefits (whether they are union or not).
Good luck!
