Legal Question in Elder Law in Massachusetts
My elderly mother who suffers from dementia as well as a list of other issues is in a nursing home. She recently was given a sex toy by an individual that works there. This of course outrages me and seems like there is some sort of legal action I can take. I expect my mother to be in good hands and this is just disgusting and indecent. She is in no way healthy enough for 'sexual activity' so had she attempted to use this she could have had a heart attack. Also, she isn't in the right state of mind. How could this caretaker give this to her!? What can I do?

File a complaint with the Administrator of the nursing home. They do not want someone to do that and risk a problem.
You can also file a complaint with the Department of Public Health. DPH licenses nursing homes. They will send an investigator to review the situation and can take disciplinary action if appropriate.
