Is it against the law to evict an elder
during the winter months? (giving only 30 days to do so).

No, but generally an elder person can be given up to a year to vacate a premises depending upon the reason for the eviction. If they have not paid rent, it is a different time line than you simply want to rent to someone else or need to raise the rent and they will not agree.
However, the Court will not allow an elder person to stay in an apartment and simply not pay rent.
