Legal Question in Elder Law in Massachusetts

Hi. A friend of mine is 77 years old and lives in the Boston area. She lives in senior housing and pays a nominal rent. She gets a small amount monthly from SS and less than $100 per month from a pension. She recently told her office manager that her son has been sending her some money monthly for about 3 years. About $250-300 a month. How will this affect her rent? What are the ramifications?

I don't like answering questions for friends, because you don't know all the facts, and since you are in FL and she is in MA, it is even less likely that you know all the facts.

The law and regulations differ a little from town to town and the enforcement is even more inconsistent. Generally, a person living in subsidized housing has to report changes in income from all sources (including lottery winnings) every month. Some places will make a change permanent even if the change was just for one month. In my view, that is not legal. If the manager has to recalculate the rent every month because the amount is not consistent, that's what s/he has to do. Whether they will go back and recalculate it for the 3 years I can't say.
