Legal Question in Elder Law in Massachusetts
Mass Health
I recently placed my 79yr. old mom in a nursing home. I am her only child. She has nursing home insurance for the next 3 years. I plan to apply for medicaid when her insuance runs out. Recently, I found out that there are permissible transfers. One permissible transfer is to the nursing-facility resident's permanently and totally disabled child. I am disabled and have been receiving SSDI benefits since 1987. Would an ''adult child'' be accepted as a permissible transfer? I will be 58yrs. old when I apply for my mom's medicaid benefits. Thank you for your time.

Re: Mass Health
There are a number of transfers that can be made before your mother applies for MassHealth. The fact that you are disabled and the fact that she has longterm care insurance will affect the transfers that she can make. To be sure that your mother makes the most of her situation, she should consult with a lawyer before making any transfers.
