Legal Question in Elder Law in Massachusetts

My mother is in a nursing home, and her 100 days covered by Medicare will run out on August 23. She has very little money, and no assets. She is putting in an application to go on Medicaid. The nursing home says she owes the full "patient paid amount" for August as well as September, even though she was on Medicare for most of the month of August. Is this correct?

The nursing home is correct. The Patient Paid Amount (PPA) is owed because MassHealth rules say that this amount must be paid before the state will begin payment.If you are seeking a "start date" of August 24, then the August PPA must be paid.

By the way, what's the rush with the application? I bet the nursing home didn't tell you that you have until November 30 before it must be filed. An experienced elder law attorney would not file so quickly. Instead, we review your mother's finances carefully before filing, so we can identify potential problems that may result in disqualification if they are not carefully explained, as well as being sure that you understand what assets are and are not countable.
