Legal Question in Elder Law in Massachusetts
nursing home rights to obtain guardianship
My mother is 87 years old woman with Alzheimer's. I am in the process to obtain guardianship for my mother. The nursing home restricted me from getting information about my mother (test results, bedsores status and so on). They indicate they are in the process to obtain guardianship!!!
How can we stop their illegal actions? We tried to transfer my mother to another facility, but received negative response. They keep my mother as a hostage in the facility.
Thank you for infornation.

Re: nursing home rights to obtain guardianship
You need a lawyer, who can intervene in the guardianship and ask the court to appoint you as guardian. If you are not interested in being her guardian, and she needs one because she is incompetent, then there is not much you can do. You should have been told to apply for guardianship long ago, and you should have done so. You can't have it both ways: you not being the guardian and no one else being the guardian.
