Legal Question in Family Law in Massachusetts
My 17 in half year old sister has been staying with me for 3 weeks ...My mother and her husband do not get along with my sister . They kicked her out and then lied to the court and said they did not . My mother and my sisters father who are divorced agreed to letting me take Sarainto my home and got me all the forms for me and my husband to fill out for gaurdianship . So I filled them out and had her father get his notarized and signed but my mother now is not signing hers . She told me she will not sign it and will not allow me to become the guardian . Which the court told me they will just summons her to court if she declines to sign . My sister does need to get hers signed and notarized which we did try to do but the bank said they need more then a student ID to use for a ID . They wanted her social . My sister asked my mother for her social and birth certificate but will not give it to her. So She basically is making this very hard to do. She is only doing this because she is still collecting child support and does not want to lose it. My sister is still in high school and still has two years left . Her school is a vocational school and is regional . They know she is now living with me and told me I need some type of paper stating that she lives here or that i am going for gaurdianship of her . If i do not get some type of proof she could be kicked out of the school. She is in a dental program and does not want to leave it. She has already made up her mind of what carrier she wants . I just do not want her to lose that because out mother is making everything so hard to do. Her father wants the child support to go to me since I am supporting her right now and cannot really afford it. What can i do to get legal gaurdianship of her / And can i get gaurdianship if my mother refuses but father does not mind me having her?
