If you have incurred physical injury, you may be able to sue him for physical abuse and injury. You clearly could seek a protective order not allowing him to come within 100 feet of you. However, all this would have a significant impact on your parents as well as your older brother.

I am not clear on what your special needs are or what injuries or abuse you have endured, if significant enough, there may be grounds for a suit.

However, if the idea is to punish your brother for his abusive behavior, I would suggest you forget it. First, it is not worth an attorney's time for such an endeavor and ultimately it is unlikely your brother will really learn from such an action. If you have an honest fear of him, that is something else and a protective order might be of use.
