Legal Question in Family Law in Massachusetts

i have a 16yo who moved from her moms to live with me (her dad) last february due to unhappiness and issues at her moms.. now she has decided she wants to move back because she misses her school and friends but I am not convinced she is safe there.. do i have options or is she free at 16 to decide where to live?

Hello,

Up until a child reaches the age of 18, child custody remains a legal issue. Although when a chld turns 14 a Judge may take the child's preference into consideration, ultimately it is up to the judge to decide what the best interests of the child are.

Your option is to retain an attorney to file a complaint for modification of the custody order as your daughter remains subject to a custodial parent until age 18 or until she is otherwise emancipated. Good Luck!
