I have a 5 yr old son. His father, who is on the child's birth certificate, and I split when he was 2 years old. We had a verbal visitation agreement that was recently written into a court document when we went to determine child support. There is NO communication between me and my child when he goes to see his father (which is = 9 days out of the month and even then the child spends half of that with the fathers parents), and there is little to no communication with me and the father regularly. When I do need to communicate with him, I send a text. If I get a response, the answer is always a fight.
What are my legal rights to sole legal and physical custody of my child?

If you have an issue with not being able to speak to him while he's in father's care, you can file a motion to address that with the court.
