Legal Question in Family Law in Massachusetts
I am 51 yrs old and have been divorced since 2002. We were married for 22 yrs & have 2 children ages 10 & 21. My ex-husband pays child support/alimony & has indicated to me that he wants to retire in October 2010 @ the age of 55 from the Post Office. He believes that the support money he pays to the family should be reduced as his income will be reduced & I will be receiving a portion of his retirement. I was granted 39% of his retirement when we divorced. I think that if he chooses to retire, that should not effect his legal obligation even if I get some of his retirement. I think these are two different issues. He wants to try to work out the details with me to avoid legal action but I said that could only lead to problems in our relationship & the people around us. I said he could email me if he wanted.

He could motion for a reduction depending on the amount of income reduction. Speak with an attorney as to your options as there are to many issues here to properly advise you.
