Legal Question in Family Law in Massachusetts

Abandonment

My wife and I have been separated for over 11 years, and i've sent her the divorce papers over 5 years ago and she refuses to sign it.

I have 3 of our children and she has been living in canada with my youngest daughter at 13 since the separation.

My eldest daughter heard about ''abandonment'' and we looked up the definition of it online, and so we know what it is, but

what is the next step? how can i file for abandonment inexpensively and without all the hassle?

I am legal resident on MA, i hope someone can help me with some information.

My daughter--name removed--told me to put down her email, if you can, please email her.

Retain an attorney to file a Complaint for Divorce for Irretrievable Breakdown of the Marriage. Good Luck!

Re: Abandonment

You should file for a simple divorce -- irretrievable breakdown -- get her served, and get it done. You should engage an attorney, as there will be difficulties based on the multi-nation issue. The custody and support of the child in Canada cannot be resolved in Massachusetts, based on the facts you have stated here.

Re: Abandonment

You need to file for divorce. Get an attorney so you can deal with the multi-national issues with respect to the daughter in Canada.

If the daughter in Canada is under 18 there will be some child support issues. If your other children are under 18 or full time college students there will be support issues for your wife.

I suggest you contact an attorney and get the divorce done.
