Re: adoption

If you are adjudicated the biological parent, the answer is basically "no." Mother should not be able to have her new husband just adopt the child out from under you. However, if there is a proceeding pending, you should be given proper notice of any motions or scheduling of the case. What do you mean when you say you have spent hours trying to get answers? Have you been named in an adoption proceeding or custrody case? When were you adjudicated as Father?

Re: adoption

NO, NO. No.

If a court has determined that your are the legal father, then she needs your permission to have the son adopted.

If she filed an action regarding adoption in which you received no notice, you need to enter your appearance to get permission to contest her action.

I assume that there is more information. If you provide me with the additional information, I can assist you.
