Legal Question in Family Law in Massachusetts

adoption from China

I have been waiting for 14 months for an adoption from china. my dossier was reviewed last month and they requested more info. we gave them the added information and we were told that that should be enough, not to worry if we were going to be declined they would have already done that. Our group was passed to the matching department and we got a call last night that stated we could not adopt because my husband is over weight and has diabetes. China put new rules into effect may of 07 and said that it was from that point on and now they are deneing us our daughter. we have put every last dime into this adoption for paper work and homestudy and fixed up our house to accomidate her and now we are not only out our daughter but out every last penny we saved.

Re: adoption from China

You signed a contract to pay without a guarantee of approval. As much as this hurts, you probably have no rights to a refund. You should consult with a contract specialist for a better opinion, however, as your agreement will govern your rights.

The governments of foreign nations certainly have the right to determine the circumstances under which they will allow children born their to be adopted, whether to couples inside the foreign nature or outside the foreign nation.
