Legal Question in Family Law in Massachusetts

alienation of affection

My boyfriend is trying to divorce his wife. We live in Massachusetts and he is interested in the alienation of affection law because his wife was unfaithful to him. The law has been statutorily abolished. What does this mean, and how is it different from being judicially abolished? Is this claim easy to use and pull off. He has plenty of evidence of her infidelity with this man, (videotapes, pictures, etc.) And statements from her ex-friends saying that she never loved him and was going to try to annull the marriage 3 weeks after thier wedding.

Re: alienation of affection

This merely means neither party can bring a civil action against the third person they believe alenated the affections of their spouse, it does not affect the various grounds for divorce. If you still have questions, please feel free to contact me.
