Legal Question in Family Law in Massachusetts
Am I allowed to keep visitation from my child's father if he has a wicked bad case of bipolar and manic depression? He's been in and out of hospitals and he's gotten arrested recently for domestic disturbance. Also, If a paternity test was just taken, does the court put the father on the birth certificate if the child was born out of wedlock?

If you want to keep visitation from the father, you need to ask the court for permission and seek a review of his ability to deal with the child.
If you do not have an attorney I suggest you get one. If need be contact Boston legal services if you qualify financially.

You can only deny visitation if the Court has issued an order that allows you to deny visitation. If you deny visitation without the protection of a court order, you will be committing a contempt of a court order and will be subject to court sanctions.
If the dna test determines who the father is, a Judgment of Paternity will order the father's name be added to the birth certificate.
