Annulment of Domestic Partnership

I am a terminally ill male (full blown AIDS)and entered into a DP several years ago in state of CA. At the time I was under extreme mental duress (posessing a documented mental disorder) and battling a drug problem. Not in full posession of my mind. After being abused emotionally and physically I moved back to Ma in 2007. I would like to annul the dp, on the grounds of my mental state at the time. Is there any grounds for this.

Anything you need to do would be in California. What you had there was not a marriage as recognized under Massachusetts law, because it was not a marriage under California law. You should make inquiry of a California practitioner.

I am sorry to hear about your current condition.

A few points:

(i) Your California domestic partnership did not automatically transform into a Massachusetts same-sex marriage by virtue of your residing here.

(ii) In order to terminate or modify the terms of your domestic partnership agreement in California, you will need to retain the services of an attorney in California.
