can an annulment be granted by a court if one person's legals status in this country is illegal?

An annulment can be granted as a result of fraud. Assuming you were married here, and the other person fraudlently misrepresented their legal status the court can annul the marriage barring any other objections.

I would agree-if the other person fraudlently told you he was a citizen then most likely yes.
