Legal Question in Family Law in Massachusetts

Assets obtained during a separation and prior to divorce

I live in Massachusetts and my husband lives in Maine. We have been separated for 5 months after a 4-year marriage. We own a home in Maine which is on the market. I would like to buy a home in Massachusetts. How can I protect my home when we file for divorce? We are planning to file for divorce but don't know if we should file in Maine or Massachusetts. He has lived in Maine for one year; and I lived there for 6 months. We have 2 small children who live with me in Massachusetts. He has no problem with my having physical custody of the children and has been paying me child support every week. I want to protect any house that I may buy in the very near future, as well as not incur any of his liabilities (and vice versa). I am looking for any advice. Thank you!

Re: Assets obtained during a separation and prior to divorce

Once you have lived in Massachussetts for One year there would be jurisdiction to file here. Consider retaining an attorney to negotiate a binding separation agreement with your Husband BEFORE filing for the divorce to accomplish the other concerns you have about division of assets, custody and support issues etc. Good Luck!

I'm an attorney in Maine and Massachusetts. After living in Mass for one year, you could file here.
