baby having fathers last name
I it leagal for a mother who just gave birth not give the baby the Fathers last name even if he is not married to her but he is the babies bialogical father. there are no restriction on the father from being at the hospital at the birth of his baby, so far as long as the mother stays civil.

The mother has the only say that matters, whether or not you are married to her or involved at all. the child will have the name she chooses.

Re: baby having fathers last name
Assuming the child is the biological offspring of the gentleman it is legal for the child to be named after him. However, there is no obligation to name the child after the biological father.
