Legal Question in Family Law in Massachusetts

I just had a baby, she is one month old.. and my fiance and i broke up, i am nursing her exclusively and not using a bottle because i cant pump enough milk. My x seems to think that i can drop her off to him NOW for the weekends and leave because he does not want to see me at ALL.. is this true? or no? what are my rights and what are his? i live in MA. i also have many concers as well, he has drug problem with cocaine, and he is an alcoholic, drinks about a bottle of wiskey a day, i had a restraining order on him last july, that i STUPIDLY changed to a "no abuse" order and that is still in effect utnil this july.. what should i do? he has been threatening me that i will go to jail if i dont drop off the baby to him for the weekend and says he wont pay me anything until i do so, and i will be forced to do it.

Baby is too young for overnight visits!

If there are no court orders then you do not have to do anything.

If you want support file a complaint for paternity, have him adjudged as the father and ask the court for child support.

I agree that the baby should not be given for an overnight visit. In fact, you should not give the baby for an overnight visit, the baby is far too young.

If you feel threatened you should get a restraining order.

If he is the father, file for child support in court. The court will take the money from the father's pay check if he doesn't pay voluntarily.
