Legal Question in Family Law in Massachusetts
babysitter doing drugs?
my sister in law regular babysits my 9month old son. We are aware that her fiance regular (several times a day) smokes pot, and enjoys a side job taking bets (as a bookie). I've become increasingly concerned for my childs safety when he visits her. My question (to reinforce with family why he won't be visiting her there alone), if he were to be ''busted'' on either pot of being a bookie, and my child is there, can my child be taken away from me? Family members are telling me I am overeacting to this. That she will not be in trouble (even though they share a residence) and that my son will be fine.

Re: babysitter doing drugs?
You say you have first-hand knowledge that there is pot smoking and illegal dealings going on while your baby is present. Rather than being concerned whether they can take your baby in the future, you should be more concerned with the present.
Example, 1. breathing in pot smoke and the brain/lung damage that can cause; and
2. placing your baby in a potential dangerous situation where illegal gambiling is taking place.
If what you are saying is true, ask your sister not to subject her nephew to such dangers while she is babysitting; and have her fiance not smoke or do his business in the presence of your son.
If your sister thinks that it is not a big deal to have her nephew subjected to these situations, then find another babysitter, quick.
