If there is a bank account in joint names (husband and wife). Can the wife legally withdraw money without repercussions
from the law.

Joint bank accounts are normally controlled by either party. This means that either husband or wife can make withdrawals. Sometimes bank accounts are set up to require two signatures. In that case, both parties must sign to withdraw funds.

Attorney Pransky is correct. She can withdraw the money but it remains as part of the marital estate to the extent it is in a separate account and not used for regular expenses.
