My ex-husband got married before I divorced him. I will be retiring soon and want to know am I entitled to any of his retirement pension and social security benefits?

If you are not divorced from him, his re-marriage is void. You are his only legal spouse of record under Massachusetts law, and the only person entitled to his benefits.

If there has been no divorce between you and him, you may want to file an action to declare his second marriage invalid to minimize the wrangling with third parties over who is his lawful wife.
