boyfriend girlfriend property question

my boyfriend and I have a ten yearold daughter together.we own a townhouse which is in his name (the loan and dead).the first condo we bought was in both our names.when we sold it I had to sighn the 40K check over for the new condo with him.now he is out drinking all the time and coming home drunk in front of my daughter.i want him out!what are my chances in keeping MY townhouse and kicking him out.he could never keep and have the responsibility of paying for this place anyways.

This will be a case which will require more than a simple complaint, as you must prove your equitable right to a claim in the house. This can be done, but is not a "slam dunk." I have been involved in a similar case, on the defending side (claiming minimal or no equitable right), and di pretty well for my client (facts, however, are always VERY important).

I suggest that you get an attorney into this sooner than later.

You may be able to file an action to get equitable relief, or to get your money back from your ex; the way he is spending your money, you had better do something quickly.

You have to file an equitable action to obtain title or get your money back. The first thing the court is going to want to know is why you did not sign the loan and deed.

I assume you are paying half the mortgage, if not more. You need to document that as well.

If he is spending your money, you need to stop that ASAP.
